Welcome to Dogventure! The terms "we", "us" and "our" refer to Dogventure. Dogventure operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Dogventure is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers, the nature of our custom-made products, and limitations of liability.

These Terms do not affect any mandatory statutory rights you have as a consumer under the laws of Spain, the European Union, or your country of residence, which take precedence over any conflicting provision below.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

All descriptions of products are subject to change at any time without notice at our sole discretion, provided such changes do not affect orders already confirmed. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Dogventure reserves the right to accept or decline your order for any reason permitted by law and at its discretion (for example, product unavailability, pricing errors, or suspected fraud). Your order is not accepted until Dogventure confirms acceptance by email. We must receive and process your payment before your order is accepted.

In the event that we do not accept, make a change to, or cancel an order, we will notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made, and will refund any payment already made without undue delay.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless otherwise agreed with us in writing.

SECTION 4 - NO RIGHT OF WITHDRAWAL (CUSTOM-MADE, PERSONALIZED PRODUCTS)

All products sold by Dogventure, including but not limited to leashes, collars, and other pet accessories, are manufactured individually for each order, based on the specifications selected or provided by the customer (such as size, length, color, material, and/or engraving). None of our products are pre-made stock items produced in advance of an order.

Because our products are made to the consumer's specifications and are clearly personalized within the meaning of Article 16(c) of Directive 2011/83/EU (as implemented in Spain under Real Decreto Legislativo 1/2007), the general 14-day right of withdrawal does not apply to any purchase made through the Services. By placing an order, you acknowledge and accept that your order cannot be cancelled or returned for convenience once production has begun, except as set out below.

This exclusion does not affect, and is entirely separate from, your statutory legal guarantee rights described in Section 7 (Legal Guarantee and Conformity of Goods): if a product you receive is defective, damaged in transit, or does not conform to what you ordered, you remain fully entitled to a repair, replacement, price reduction, or refund as applicable, at no cost to you.

If we are ever unable to fulfil a customized order as specified (for example, due to a material shortage), we will contact you before proceeding and, if no acceptable alternative can be agreed, you will receive a full refund.

Any further voluntary return or exchange options we may offer at our discretion are described in our separate Refund Policy [INSERT LINK]; such options do not constitute, and should not be confused with, a statutory right of withdrawal.

SECTION 5 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice, except that the price applicable to an order already confirmed will not change. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Posted prices include applicable VAT where required by law; shipping, customs or import charges (where applicable) will be shown separately before you complete your purchase.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores, and to promptly update this information as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use the payment method for the purchase, and (iii) you will pay the charges incurred at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 6 - SHIPPING AND DELIVERY

We will make reasonable efforts to dispatch and deliver products within the estimated timeframes shown at checkout. Delivery times are estimates and may be affected by circumstances outside our reasonable control (such as carrier delays or customs processing), in which case we will inform you as soon as reasonably possible. Risk of loss or damage to the products passes to you upon delivery to you or a person indicated by you, in accordance with applicable EU consumer law.

SECTION 7 - LEGAL GUARANTEE AND CONFORMITY OF GOODS

As a consumer in the EU, you benefit from the legal guarantee of conformity for a period of 3 years from delivery under Spanish law (Real Decreto Legislativo 1/2007 and implementing regulations), for defects that exist at the time of delivery and become apparent within that period. This legal guarantee is provided free of charge and is independent of, and not limited by, any commercial warranty offered by a manufacturer.

If a product does not conform to the contract, you are entitled to have it repaired or replaced free of charge, or, where this is not possible or proportionate, to an appropriate price reduction or termination of the contract, in accordance with applicable law.

SECTION 8 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Dogventure, its affiliates or licensors and are protected by Spanish, EU and international copyright, trademark and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Nothing in these Terms grants any license or other rights to you under any patent, trademark, copyright, or other intellectual property of Dogventure, Shopify or any third party.

Dogventure's names, logos, product and service names, designs, and slogans are trademarks of Dogventure or its affiliates or licensors. You must not use such trademarks without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 9 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available," without endorsement, and to the extent permitted by law we shall have no liability arising from your use of optional third-party tools. Any use of such tools is at your own risk, and you should review the relevant third-party's own terms before use.

SECTION 10 - THIRD-PARTY LINKS

The Services may contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you access third-party sites, you do so at your own risk, and complaints regarding third-party products or services should be directed to that third party.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Dogventure is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our Store are made directly with Dogventure. Shopify is not a party to, and is not responsible for, any aspect of the sales between you and Dogventure, including any injury, damage, or loss resulting from purchased products and services. This does not affect any statutory rights you may have that cannot be waived under applicable law.

SECTION 12 - PRIVACY POLICY

All personal information we collect through the Services is processed in accordance with our Privacy Policy [INSERT LINK] and applicable data protection law, including the EU General Data Protection Regulation (GDPR) and Spanish data protection legislation (LOPDGDD). Because the Services are hosted by Shopify, Shopify also processes certain personal data as a processor/controller in order to provide and improve the Services. We may, but are not obligated to, monitor, edit, or remove Feedback at our discretion. We are under no obligation to keep Feedback confidential, compensate you for it, or respond to it, and we assume no liability for Feedback posted by you or third parties.

SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct such errors and to update information at any time; where an error materially affects an order already confirmed, we will inform you and offer the option to confirm the order at the corrected terms or cancel it with a full refund.

SECTION 15 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not, directly or indirectly: (a) use the Services for any unlawful or malicious purpose; (b) violate applicable regulations or laws; (c) infringe our intellectual property rights or those of others; (d) harass, abuse, or harm any person; (e) transmit false or misleading information; (f) send spam or unsolicited promotional material; (g) impersonate any person or entity; or (h) engage in conduct that restricts or inhibits others' use of the Services or may expose us or users to liability.

You further agree not to: (a) upload viruses or malicious code; (b) reproduce, duplicate, or exploit any portion of the Services without authorization; (c) collect or track others' personal information; (d) engage in phishing or pretexting; (e) use bots, scrapers, or automated/AI tools to access the Services except as permitted under Section 16 below; or (f) bypass or circumvent our security or access-control measures. We reserve the right to suspend or terminate your account if we determine, acting reasonably, that you have violated these Terms.

SECTION 16 - AGENTS

This section applies if you use, allow, or enable an "Agent" (any software that takes autonomous or semi-autonomous action on your behalf) to access or interact with the Services.

No Agent may access the Services unless it: (i) identifies itself as an Agent in the user-agent string of all HTTP/HTTPS requests (format: "Agent/[agent name]"); (ii) does not conceal that it is a computer program, including by mimicking human behavior or bypassing CAPTCHAs; (iii) responds truthfully to any prompt asking whether it is a human or a computer; and (iv) does not circumvent any measure we use to control Agent access. We may limit or block Agent access at any time, including by technical measures.

We may terminate this agreement or your access to the Services in cases of a material breach of these Terms, subject to applicable law, and you will remain liable for amounts already due. The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Legal Guarantee, Indemnification, Severability, Governing Law, Privacy Policy, and any other provision that by its nature should survive.

SECTION 18 - DISCLAIMER OF WARRANTIES

The information presented on the Services is made available for general information purposes, and we do not warrant its completeness or accuracy beyond what is required by applicable law. To the extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of any kind except those which cannot be excluded under mandatory consumer protection law (including the legal guarantee of conformity described in Section 7).

Nothing in these Terms excludes or limits any right or remedy that you have as a consumer under mandatory provisions of Spanish or EU law, including your statutory legal guarantee rights described in Section 7, and any such exclusion is void to the extent it conflicts with such mandatory law.

SECTION 19 - LIMITATION OF LIABILITY

To the extent permitted by applicable law, Dogventure's liability for damages arising from your use of the Services or purchase of products shall be limited to direct, foreseeable damages, and shall not extend to indirect or consequential losses (such as lost profits or lost data) except where such loss was a foreseeable consequence of our breach. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded under Spanish or EU consumer protection law.

SECTION 20 - INDEMNIFICATION

You agree to indemnify and hold harmless Dogventure, Shopify, and our respective affiliates, officers, directors, employees, and agents from claims, damages, and reasonable legal costs arising out of (1) your breach of these Terms, (2) your violation of any law or third-party right, or (3) your misuse of the Services, except to the extent such claim results from our own breach or negligence.

SECTION 21 - SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

SECTION 22 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements.

SECTION 23 - ASSIGNMENT

You may not transfer or assign this agreement or your rights under it without our prior written consent. We may transfer or assign these Terms, provided this does not reduce the guarantees available to you as a consumer.

SECTION 24 - GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by Spanish law. Any dispute shall be submitted to the Courts of Barcelona, Spain, without prejudice to any mandatory right you have, as a consumer, to bring proceedings before the courts of your own country or place of habitual residence within the EU, which cannot be waived.

The headings used in this agreement are included for convenience only and do not limit or affect these Terms.

SECTION 26 - CHANGES TO TERMS OF SERVICE

We reserve the right to update these Terms of Service by posting changes to our website. We will notify you of material changes in accordance with applicable law with reasonable advance notice before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of those changes; this does not apply retroactively to orders already placed under prior Terms.
